General Terms and Conditions of Use – Betandeal Insights

1. Purpose and Service Definition

These Terms and Conditions govern access to and use of the Betandeal Insights platform (hereinafter, the "Platform"), owned by GLOBAL GAMING MARKETING SERVICES, SL, with Tax Identification Number B51040673 and registered office at Calle Real nº 7, 51221 Ceuta, Spain (hereinafter, the "Company").

The Platform is a technical tool designed for the centralization, visualization, and analysis of performance metrics and statistics from social media profiles (primarily Facebook and Instagram).

The service consists of facilitating the technical connection between the Creator's accounts and the Platform through third-party Application Programming Interfaces (APIs) for the extraction of statistical data for informational and audience analysis purposes.

2. Creator Status and Acceptance

A Creator is defined as any individual or legal entity who voluntarily connects their profiles, accounts, or digital channels to the Platform.

Use of the Platform grants the status of user and implies full and unconditional acceptance of these Terms and Conditions and the Privacy Policy.

3. Access and Registration Requirements

To use Betandeal Insights, the Creator must:

1. Be of legal age under Spanish law.
2. Be the legitimate owner of, or have explicit authorization to manage, the social media accounts being connected.
3. Complete the registration process by providing accurate and up-to-date information.

The Company reserves the right to deny or withdraw access in the event of non-compliance with these requirements or fraudulent use of the Platform.

4. Connection with Third-Party Platforms (Meta/Facebook/Instagram)

The operation of the Platform depends on integration with third-party services. By linking their accounts, the Creator expressly authorizes Betandeal Insights to access and collect statistical data (reach, impressions, interactions, audience demographics, etc.).

Security Guarantee: The Platform does not store or request the Creator's login credentials (passwords). Connections are established through secure access tokens provided by the service provider (for example, Meta).

5. Informational Nature of Statistics

The display of metrics within the dashboard is provided solely for informational purposes. Connecting accounts does not imply:

• The existence of an employment or agency relationship.
• An obligation to participate in specific advertising campaigns.
• A guarantee of engagement or hiring by Clients or Operators.
• Any financial compensation solely for connecting an account.

6. Creator Obligations

The Creator agrees to:

• Not use the Platform for unlawful purposes or in a manner that infringes the rights of third parties.
• Maintain the confidentiality of their Betandeal Insights account credentials.
• Not interfere with the technical operation of the Platform or attempt to access other users' data.

7. Intellectual and Industrial Property

The Company owns all intellectual property rights relating to the software, design, interface, and algorithms of Betandeal Insights.

Access to the Platform does not grant the Creator any exploitation rights over it beyond the strictly personal and professional use described herein.

8. Personal Data Protection

The processing of the Creator's personal data and the data obtained through connected accounts is governed by our Privacy Policy, in compliance with Regulation (EU) 2016/679 (GDPR).

The Creator guarantees that they have informed their audience, where legally required by the originating platforms, about the processing of statistical data derived from their activity.

9. Account Termination and Data Deletion Procedure

The Creator may terminate the service at any time by following these instructions:

1. Access the "Account Settings" or "Linked Accounts" section within the Betandeal Insights dashboard.
2. Select the "Unlink Account" or "Delete Profile" option.
3. Alternatively, revoke permissions directly from the settings of the Facebook or Instagram account (under the "Apps and Websites" section).
4. Request account termination by sending an email to [email protected].

Following account disconnection, the Company will immediately cease data collection and proceed with the deletion of stored historical data, except for data that must be retained due to legal obligations and kept appropriately restricted.

10. Limitation of Liability

The Company shall not be liable for:

• Service interruptions caused by technical maintenance or force majeure events.
• Failures, errors, or changes in third-party APIs (Meta, etc.) affecting data availability.
• The accuracy of statistical data when such data originates directly from external platforms.

11. Amendments

The Company reserves the right to amend these Terms and Conditions in order to adapt them to legal developments, technical changes, or requirements imposed by social media service providers.

Any amendments will be communicated to the Creator through the Platform or by email.

12. Governing Law and Jurisdiction

These Terms and Conditions shall be governed by Spanish law.

Any dispute arising from these Terms and Conditions shall be submitted to the Courts of Madrid, Spain, unless mandatory consumer protection laws establish a different jurisdiction.
